Cancellation and Return Policy

Please make sure you want your items before you purchase them as we begin the fulfilment process on all orders as soon as possible. All orders cancelled after 24 hours are subject to a Rs.500/- administration fee whether or not your order has shipped. If your order has shipped, you (the buyer) will also be responsible for actual return shipping charges. Refunds will only be issued to the original credit card that you use when placing your order. Please see our Refunds policy below for details and any additional charges and please also contact us as soon as possible via email on our Contact Us page.

Damages

Please report damaged or defective merchandise to us immediately by email or our Contact Us. Photos of the items and the packaging must be provided. This will speed up the resolution process. We strongly recommend at the time of delivery, if you notice any cartons that look dented, crushed or just not right, open them immediately and inspect the contents. If the contents appear to be damaged, please notate it on the delivery ticket, refuse that item only and contact us as soon as possible for instructions.

Refunds

We are happy to provide refunds for any defective products. To be eligible for a return, your item must be unused and in the same condition that you received it. You must also have the original receipt or proof of purchase. We work hard to ensure that each item that leaves our warehouse is not defective so that you do not have this experience.
Please count and inspect your order immediately upon arrival. Freight companies will no longer pay for any claims made past 7 days from the date of shipment! Any damage found after this 7 day period will be the customers responsibility. You must keep all the shipping boxes, packing material and the damaged items for the carrier to inspect before any reimbursement or credit will be made to your account. Credit will be given only after the product is received and inspected at our warehouse.
Important: Be sure to re-package product carefully so it is secure and will not be damaged in transport. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. You should consider using a trackable shipping service or purchasing shipping insurance. Shipping insurance costs are non-refundable. We don’t guarantee that we will receive your returned item. In addition to the above return shipping charges, there is a 15% restocking fee on all items returned.
Please contact us via our contact page for more details about receiving a refund to get this process started. Customer must receive a return authorization code from Gaarden Walls prior to returning items. Items without a return authorization will not be accepted. Please contact us via our contact page to obtain a return authorization.
Customers have 15 days from the date of invoice to contact Gaarden Walls for a return authorization. All sales are final after 15 days.
Containers must be unused and free of soil to receive a refund. Used containers will not be accepted for return, nor will credit be awarded if containers are used or damaged. It is the responsibility of the buyer to properly package all returns with original packaging materials and insure the product for return shipping. Gaarden Walls accepts no responsibility for damage to items during return shipping.

Product Warranty

Gaarden Walls PRODUCT WARRANTY AND DISCLAIMER

LIMITED WARRANTY

A. Gaarden Walls warrants the following with respect to Product manufactured by Gaarden Walls or bearing the Garden Walls label: (1) that the Product is free from defects in material and workmanship and when used in accordance with the user manual supplied with the Product, will operate substantially in accordance with the applicable functional specifications applicable to the product release purchased; and (2) that upon payment in full for the Product, they shall be rendered free and clear of liens, claims or encumbrances of any kind.
B. The above Product warranty shall extend to the original end user purchaser of the Product for a period of Six (6) months from the date of shipment, unless otherwise stated on a formal quotation issued by Gaarden Walls. With respect to any products sold but not manufactured by Gaarden Walls or bearing the Garden Walls label, Gaarden Walls will assign to Customer all available manufacturer warranties.
C. Gaarden Walls sole liability under this warranty shall be (a) either to repair or to replace, at Gaarden Walls’s option, the defective Product component(s) in accordance with Gaarden Walls’s return and repair procedures, or (b) if after repeated efforts Gaarden Walls is unable to resolve the defect by repair or replacement, to refund the purchase price upon return of the defective item. The warranty period for repaired or replaced Products shall be the remainder of the original warranty period for the repaired or replaced item. Gaarden Walls shall incur no obligation under this warranty if (1) the allegedly defective Product is returned to Gaarden Walls more than thirty (30) days after the expiration of the applicable warranty period; (2) if Gaarden Walls’s verifiable tests disclose that the alleged defect is not due to defects in material or workmanship; or (3) if, in GaardenWalls’s sole judgment, the Product has been subjected to misuse or neglect, alteration, improper maintenance or damage due to excessive physical or heat or stress. This Product warranty is void if the serial number of the Product has been defaced, altered or removed.
D. NO WARRANTY or GUARANTEE FOR VEGETATION or plants sold by gaarden walls
E. WARRANTY FOR OTHER MATERIALS: NO WARRANTY for Stainless Steel (SS), Mild Steel (MS) or Aluminum, Polyethylene Plastic Sheets, Moisture Retention Material (MRM14), and for water catch basins.
And for Irrigation components, brackets, spacers, Motors, Timers, Irrigation System, Lights and edging details etc. items of the system will be covered by a separate warranty issued by the concern Manufacturer or provider and will not be covered under the Gaarden Walls product warranty.

WARRANTY LIMITATIONS AND EXCLUSIONS

A. THE WARRANTIES SET FORTH ABOVE FOR THE PRODUCTS PROVIDED HEREUNDER ARE COMPLETE AND ARE IN LIEU OF, AND CUSTOMER HEREBY WAIVES, ALL OTHER CONDITIONS, REPRESENTATIONS, AND WARRANTIES, EXPRESS OR IMPLIED BY STATUTE, USAGE, CUSTOM OF THE TRADE OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOTWITHSTANDING ANY OTHER OR PRIOR STATEMENT, WRITTEN OR ORAL, GaardenWalls MAKES NO OTHER WARRANTIES REGARDING THE QUALITY OF ITS PRODUCT(S) OR THE MATERIALS COMTEMPLATED HEREUNDER AND GaardenWalls EXPRESSLY DISCLAIMS ANY WARRANTIES OF DURABILITY, THAT THE PRODUCT WILL MEET ALL OF CUSTOMER’S NEEDS OR THAT THE OPERATION OF THE PRODUCTS WILL BE ERROR FREE.
B. Customer acknowledges and agrees that the Products supplied under this Agreement are intended for standard commercial uses and are not specifically designed, manufactured or intended for use or resale in critical applications or hazardous environments requiring fail-safe performance and in which the failure of Products could lead directly to death, personal injury, or severe physical or environmental damage (“High Risk Activities”). Gaarden Walls and its suppliers explicitly disclaim any express or implied warranty of fitness for any such use and the customer hereby agrees to release and hold Gaarden Walls harmless from liability resulting from liability resulting out of or in connection with implementation of these Products in High Risk Activities.
C. LIMITATION OF LIABILITY. GaardenWalls’S LIABILITY SHALL BE LIMITED TO THE PRICE PAID BY CUSTOMER FOR THE GOODS OR TO REPLACEMENT OF THE GOODS, AND CUSOMTER SHALL BE ENTITLTED TO NO OTHER REMEDY, REGARDLESS OF THE FORM OF THE CLAIM. GaardenWalls SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE USE OF OR INABILITY TO USE THE PRODUCT, WHETHER OR NOT SUCH DAMAGES ARE FORESEEABLE AND WHETHER OR NOT CUSTOMER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUE, ATTORNEYS’ FEES, DAMAGE TO BUSINESS, LOSS OF USE OF EQUIPMENT, COST OF CAPITAL, DOWN-TIME COSTS OR DAMAGES FOR DELAY, OR FOR DAMAGES FOR ECONOMIC LOSSES OR PROPERTY DAMAGE ARISING FROM ANY ACTS OR OMISSIONS, WHETHER IN NEGLIGENCE, STRICT LIABILITY, OR OTHER PRODUCT LIABILITY THEORIES. THE LIMITATIONS OF LIABILITY AND WARRANTY DISCLAIMERS STATED IN THIS AGREEMENT FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES AND APPLY REGARDLESS OF WHETHER ANY LIMITED REMEDY HEREUNDER FAILS OF ITS ESSENTIAL PURPOSE.

PRODUCT REPAIR AND RETURN PROCEDURES.

A. No Product shall be returned without prior Gaarden Walls authorization. Inoperative or malfunctioning Product must be returned by Customer in protective material, securely packaged to prevent damage in transit with the original proof of purchase, and shipped prepaid to Gaarden Walls - No.22,80ft road, MKP Main Road, Padmanabhanagar, Bangalore - 76
B. Gaarden Walls will return repaired/replaced Product via surface freight to Customer’s location. The cost of expedited freight, if requested, shall be at Customer’s expense. Product found to be operable after testing (i.e. no trouble found), may be subject to Gaarden Walls’s then-current handling charge.
C. Repairable out-of-warranty Product will be repaired at Gaarden Walls’s then-current repair charges upon receipt of the Product and Customer’s applicable purchase order or other written authorization to repair.

Terms of Sale

These Terms of Sale are an integral part of and applicable to each purchase of products from Gaarden Walls. By purchasing our products, each customer consents to these Terms of Sale.

Limited Warranty

All products are sold with a Limited Warranty. Notwithstanding any warranty, Gaarden Walls disclaims any responsibility for damage to the product, plants or customer’s premises due to misuse, overloading, accident, casualty, damage, improper maintenance, alteration or any other cause not the result of defective design, material or workmanship. Any repairs/replacements made to the product after expiration of the warranty will be made at customer’s expense. No warranty will be honoured unless payment has been received in full.

Limitation on Liability

Gaarden Walls is not responsible or liable for care and maintenance of plants used in our Green O2 Living Wall panels, Recur Green O2 Living Wall systems, Compact Kit or any other products related to Gaarden Walls. Gaarden Walls is not responsible or liable for water damage to interior or exterior of buildings, homes, or finishes due to misuse or accidental moisture dripping from plants, lack of maintenance of watering systems, or for any reason for moisture damage or loss due to damages of any kind.
It is up to the purchaser to properly protect all surfaces from water exposure or overflow by providing water catchment drain trays and/or vapor barriers to areas of potential damage. Although our Green O2 Living Wall Systems are easy to install, plant and maintain on your own, we also recommend to hire qualified landscape maintenance professionals to assist with plant selection, planting, watering, feeding, pest control, lighting, and general maintenance to assure optimal health for the Green O2 Living Wall. Gaarden Walls is not responsible and shall be held harmless for damage to buildings, water leakage, loss of plants, bodily harm, or any accidental damages of any kind. Gaarden Walls does not provide installation services and makes no representation or warranty with respect to the services of any third party that installs its products.

Limited Liability for Installations

Estimates

Gaarden Walls estimates product prices based the information available at the time and its years of experience with customers. However, occasionally there may be a difference between the estimate and the final balance owed. This can be due to the actual materials required, customer changes or other factors. If the actual price is less than the estimated contract price, that amount will be discounted on the final payment due Gaarden Walls. If the actual price is more than the estimated contract price, that additional amount will be added to the final payment due, and customer is responsible for payment of such amount.

Payments

Customer will pay Gaarden Walls a non-refundable 50% deposit of the total invoice price upon submitting an order or acceptance of a proposal. Gaarden Walls will invoice customer for the remaining 50% when work is substantially complete, as determined by Gaarden Walls. Such invoice shall be paid by customer before completion of project.
If the total balance is not received by Gaarden Walls by the end of the 15-day period, interest will accrue on the customer’s unpaid balance at the lesser of 1.5% interest per month or the maximum interest rate permitted by applicable law. Failure to pay within 15 days of the invoice date will constitute breach of this agreement, and customer shall be responsible for all costs of collecting any remaining balance, including attorneys’ fees.

Permits

Customer is responsible for securing all permits necessary for installation of our products.

Project Start and Completion

An estimate of the number of days to complete the contracted work and an expected start date may be provided as a courtesy. However, there might be delays in the beginning date or completion date due to poor weather or other circumstances beyond the control of Gaarden Walls. Those delays will not alter or invalidate any part of our contract, nor will they entitle customer to additional rights under the contract.

Changes

On rare occasions, circumstances arise beyond the control of Gaarden Walls that may prevent construction of the project exactly as planned. Although Gaarden Walls will use commercially reasonable efforts to minimize this impact on the design and construction, customer acknowledges this possibility and agrees to cooperate with Gaarden Walls in all necessary design adjustments.
If the customer wishes to change any part of the project after ordering our products, but prior to commencement of product installation, which results in additional material or labor costs for Gaarden Walls or results in delays in the completion of the project, these costs will be added to the remaining balance of the contract and billed as part of the original agreement. Any such changes in the design or contract, whether the changes result in additional time, cost, or neither, must be made in writing and signed by both parties using a Change Order Form. Each change made by customer during installation will result in a Rs.5,000/- charge in addition to any additional charges for materials or labor that are incurred by Gaarden Walls as a result of the change. Such Rs.5,000/- charge will apply regardless of the impact of the change on labor or material costs.

Ongoing Maintenance

Following installation of the Green O2 Or Recur Green O2 Living Wall, the system must be provided with a regular maintenance from a qualified landscape maintenance professional
All the Green O2 & Recur Green O2 Living walls come with a maintenance contract. A fix monthly fee guarantees (Fee depends up on size and height of the Green O2 / Recur Green O2Living Walls) the good condition of the Gaarden Walls in an all-inclusive price. Gaarden Walls also offers a high-technology maintenance system.

Humidity

Customers should note that Living Walls create additional humidity in enclosed spaces. Additional ventilation may be required to prevent fogging and of nearby windows.

Infestation

In certain circumstances, insects may infest Living Walls and/or may be brought in with new plant material. If infestation becomes a problem, a botanical consultant may be required to provide proper correction of the problem. If the problem is unresolvable, all plants may require removal for system bleaching. In which case all plants must be replace with new plants in the Living Wall. Gaarden Walls is not responsible for the quality or potential problems with plants, including but not limited to insects; however, plant providers and/or nurseries may have guaranteed the plants.

Irrigation Systems

Gaarden Walls claims no liability or responsibility for operation, maintenance, or failure of irrigation systems, including but not limited to any irrigation systems we provide. Any malfunction of equipment must be handled directly with the manufacturer. Drip irrigation tubing must be inspected regularly to ensure adequate and even water flow. Tubing and emitters or soaker-hoses can become clogged at any time and may need to be fully replaced. Pressure Regulators can become defective over time and need to be checked for proper operation. Excessive pressure or regular maintenance of plants can cause irrigation tubing connections to come loose and spray water at any time. All connections should be periodically inspected to avoid unexpected water flow. Timers and valves may fail for any reason including loss of power, low timer batteries, disconnected water source, valve failure, wires disconnected by tampering or rodents.
Green O2 Or Recur Green O2 Living Walls must be constantly monitored to ensure regular watering. During any outage of the automatic system, immediate action must be taken to prevent plant loss which may include daily hand watering until the automatic system is restored. Water filters must be replaced on a regular basis depending on the purity of local water sources. Failure to keep filter replaced may cause water flow to stop. Water filtering is required to remove excessive mineral buildup in the system and remove chlorine which helps maintain proper pH and microbial activity in roots. Food injectors must be checked and maintained to ensure proper operation. Injectors may require yearly replacement of parts as specified by the manufacturer. Liquid food supplies must be topped off and made available to ensure proper feeding of plants. Proper food type and concentration must be maintained for the type of plants selected. Consult with plant supplier to determine the type and concentration for hydroponic constant feeding required to provide optimal growth for the plants chosen.
Irrigation system connections can leak at any time therefore proper drainage and drip pans beneath all water connections must be provided. Gaarden Walls is not responsible for loss of plant material, operation of irrigation systems or for any damage or labour costs incurred, or duress caused by irrigation systems used in our Living Wall panels and systems.

Termination

This agreement may be cancelled by the customer by emailed notice to gogreen@gaardenwalls.com before midnight the third business day after customer has placed the order. If after that time customer wishes to terminate this contract, customer must give Gaarden Walls three (3) days advance emailed notice. Gaarden Walls will retain any monies paid by customer up to the effective date of any termination and is entitled to any expenses for materials or other expenses for preparation incurred by Gaarden Walls.

VENDOR TERMS & CONDITIONS:

These terms and conditions shall apply to every sale made with Gaarden Walls. Placing an order indicates the acceptance of these terms of trade.

Price:

  1. Unless otherwise stated, the purchase price is exclusive of Goods and Services Tax and freight.
  2. Prices are subject to change at any time before orders are confirmed.

Payments & Deposits:

Unless otherwise specified in the Order, a deposit of fifty-per¬cent (50%) of the Product / Complete Order price (“Deposit”) is due by the Confirmation Date. The remain¬ing balance is due after delivery. All past due amounts shall accrue interest (compounded monthly) from the date due until paid, at the rate equal to the lesser of (a) the maximum amount allowed by law, or (b) 1.5% monthly service charge is billed on all overdue accounts. This represents an 18% annual interest rate. In the event the account, plus interest, is not paid in full within a reasonable amount of time (3 months) and a collection agency or lawyer is required, the purchaser agrees to pay all costs and collection fees.
NOTE: No Additional Orders will be acknowledged if customer account has not been paid in full (Including Incurred Interest).

Freight:

  1. Freight is charged at actual cost. Any estimate supplied by Gaarden Walls will be subject to the final weight and volume of the consignment.
  2. All risks and liabilities for plants will pass from Gaarden Walls to the Purchaser upon loading onto a transport provider bound for the consignee.
  3. All plants packed onto pallets and boxed will be professionally packed. Packing material and a loading fee will be charged to the buyer at cost.
  4. Do not sign the consignment note unless you have checked the correct number of plants has been delivered and are in an acceptable condition. Signing a consignment form absolves the fright company from any damage claims.
  5. Gaarden Walls must be notified immediately if there are any problems with the order and we will endeavour to solve them as quickly as possible.
  6. Gaarden Walls accepts no liability for failure to deliver goods by a specified date and/or time. No liability is accepted for any consequential loss incurred to the customer or third party by the non-delivery of the ordered goods.
  7. Any damage or short supply should be notified to us no later than 3 days after date of drop off or the claim will be null and void.

Minimum purchase quantities:

  1. Minimum purchase of quantity of 30 Kokedama plants – the order can be made up of multiple varieties.
  2. Because of the high cost in lifting small orders, a surcharge will apply when ordering less than 5 units per variety.

Warranty:

  1. While every care is taken to ensure that all plants are true to type, no warranty, implied or expressed can be given as to description or performance.
  2. The plants supplied by us will do well and conditions suitable to that species.

NOTE: Every effort will be made to provide the size ordered, but sometimes substitutions are necessary. We May substitute, without notice to the buyer, the closest available size and grade. If substitutions are not acceptable, please tell us when ordering. Also, please tell us if your preference is to have a larger or smaller grade

Returns and cancellation policy:

  1. We believe that all goods are supplied in good conditions and of reliable quality. We will not be responsible for the health and welfare of plants after they have been despatched (issues arising from transit should be taken up with the courier) nor will we be responsible for the replacement of any plant which fails to grow due to unsuitable soil conditions, adverse weather, damage, neglect or any other cause beyond our control.
  2. In the event of any error of ours in making up a consignment, please notify us immediately and confirm in writing within 7 days, when the matter will be put right either by a further despatch or by a refund of your payment. If you have any query or complaint about goods, let us know promptly, for we cannot be responsible for failures occurring weeks or months later, by which time so many circumstances beyond our control or knowledge are likely to have had a bearing on the matter.

  4. If an order is cancelled before we despatch it, then a full refund will be made. Orders cannot be cancelled after they have been despatched.

Other:

  1. Plants may only be returned for credit if there has been damage in transit or in the rare event that the plant is not an acceptable grade – a credit will be raised upon receipt of the damage plant/plants back onto the Gaarden Walls. Returns will only be accepted if we are notified within 3 days of delivery.
  2. 2. Disclaimer: We endeavour to keep all information on the website up to date, but stock levels are changing continuously so information should be treated as a guide only.

Confidentiality:

The Parties shall keep all negotiations confidential and maintain the contents of these Terms & Conditions together with Vendor Agreement in strict confidence and shall make no announcement or disclosure without the prior written approval of the other Party save in respect of (i) disclosures necessary to be made to each Party’s consultants, advisors, employees / directors on a need-to-know basis and provided that such third parties are bound by obligations of confidentiality; and (ii) disclosures required by law.

Governing Law and Jurisdiction:

These Terms and Conditions together with the Vendor Agreement shall be read and construed in accordance with the laws of India. All disputes arising out of or in relation to these Terms and Conditions and/or the Vendor Agreement shall be subject to the exclusive jurisdiction of courts at Bangalore, India.
